Terms of Use Agreement

Welcome to Splash, Splashweb.in a website and online service owned and operated by Minds Group. ("Splash", "SplashWeb.in", "we" or "us"). This page explains the terms by which you may use our service. By accessing or using the Splash services, website, applications and software provided through or in connection with the service, including through a mobile device ("Service"), you signify that you have read, understood, and agree to be bound by this Terms of Use Agreement ("Agreement"), whether or not you are a registered user of our Service.

We reserve the right to amend this Agreement at any time and without notice. If we do this, we will post the amended Agreement on this page and indicate at the top of the page the date the Agreement was last revised. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms of Use. If you do not agree to any of these terms or any future Terms of Use, do not use or access (or continue to access) the Service. This Agreement applies to all visitors, users, and others who access the Service ("Users", "Splashers", "Group Members", "Group Administrator").

By Accepting terms of Splash you also willfully Agree and Accept all the Terms and conditions specified by Telecom Regulatory Authority Of India

Minds Group constantly strives in providing the highest service levels to its Users. Minds Group completely owns Splash as a communication service.It will not hold liabilities for inturruption or unavailability of its services due to to various reasons that might be required to run Splash as this involves other Telecommunication providers and also has lot of complex medium of Multi vendor and multi-levlel support structure including technolgical barriers and breakdowns which would cover all these aspects specified here

i. The Service might also consist of a browser interface, message application, SMS gateway access, data encryption, data transmission, data-access and data storage.

ii. Splash makes no guarantees as to the continuous availability of the service or any specific feature(s) of the service. Splash reserves the right to change or terminate the service and/or alter the terms and conditions of this Agreement at any time without any prior notice.

iii. Messages shall be deemed to have been delivered when Splash delivers the messages to the immediate destination, including SMTP servers, mobile telephone networks, or any other intermediary server/API that is designated the point of delivery for the message. Splash does not guarantee delivery on behalf of mobile telephone providers.

iv. Splash makes no guarantees to its network coverage. Splash provides extensive coverage to the majority of carriers, yet Mobile providers/carriers may opt to not be part of the Splash network, resulting in undelivered messages.

i. Splash holds every right to restrict unauthorized methods of usage and has got strict confidentiality policies for its customers personal information which will not be shared or redistributed.

ii. You acknowledge and agree that if Splash disables access to your account, you may be prevented from accessing the Services, your account details or any files or other content which is contained in your account.

iii. Splash is constantly innovating in order to provide the best possible experience for its users. You acknowledge and agree that the form and nature of the Services which Splash provides may change from time to time without prior notice to you.

iv. As part of this continuing innovation, you acknowledge and agree that Splash may stop (permanently or temporarily) providing the Services (or any features within the Services) to you or to users generally at Splash’s sole discretion, without prior notice to you. You may stop using the Services at any time. You do not need to specifically inform Splash when you stop using the Services.

v. Splash will not edit, monitor or disclose any personal information about the User or their account which includes its contents, without the User's prior permission unless such action is necessary to: (1) conform to legal requirements or comply with legal orders, (2) defend and protect the property or rights of Splash, (3) enforce this Service Agreement or protect Splash business or reputation, (4) respond to request for identification in connection with claim of trademark or copyright infringement by the User (5) or a claim by a third party that a User is using the service in any prohibited manner in the Member Conduct Code.

vi. The User agrees that Splash may access its account, including its contents for reasons above and to attend to technical issues and/or servicing.

vii. The user grants Splash the right to send communication via e-mail and/or text message regarding company notices, updates, upgrades or information Splash deems important for its users to be notified about regarding the Splash service.

viii. Splash assumes no responsibility/liability for the failure to store information regarding user’s information, contact list and/or recently transmitted messages. Splash reserves the right in the future, at its sole discretion, with prior notification to limit the amount of text messages available to each group.

ix. Splash prides itself on the timely delivery of messages, yet messages may be delivered late due to network traffic or queuing, resulting in sometimes late messages.

x. Splash also reserves the Rights in modification and changes in the fee structure without prior intimation to its users.
